Food license is a highly crucial part of the food business as it is vital proof that what you are offering to your consumers is of top-notch quality. Having a license is compulsory under the law. To provide hygienic food to the public, it is requisite to pass legislation on safety and hygiene. It is highly significant for a food business to carry out a food license registration process in India before starting a food business.
It is also feasible to transfer your license under the food safety and standards act, 2006.
The leading body responsible for supervising and controlling food safety is the food standards and safety authority of India (FSSAI). It is compulsory for every business in the industry of food to get the FSSAI simple registration done.
While registering, you would be offering details related to the company’s type, product segment or formulation, manufacturing size, and so forth. In case there are changes, FBOs (food business operators) are expected to report it within a stipulated time to the food safety and standards authority of India (FSSAI).
FSSAI food registration is mandatory for cooking food and anyone who serves the food at multiple levels before it actually hits the consumers, like raw material, packing, packaging, production, and delivery to canteens, as well as the companies who have authority to market them. It is compulsory for those who offer to people from their homes. As long as you are earning money out of it, you will have to register under FSSAI.
Various classes of licenses
Businesses whose turnover does not go beyond Rs. 12 lacs can apply for basic FSSAI food safety registration, while businesses whose turnover exceeds Rs. 12 lacs and up to Rs. Twenty lacs can go for a state license, and the business whose turnover exceeds Rs. Twenty lacs annually can go for a central license.
Changes/transfer/alteration in the license
If the FSSAI license has been issued, you will have to follow various processes to alter it. It needs a filing of an application to modify the FSSAI license or registration. For a small business, FSSAI registration works, but for a large-scale food business, an FSSAI license is compulsory. But what if the FSSAI holder dies?
The FSSAI license can be transferred to a legal representative or any family member of the person who died with the FSSAI license. The legal family member or agent should request for the transfer of the certificate to the concerned authority in his/her favour. The application might be denied or approved by the authority after due verification. Nonetheless, the FSSAI license authority cannot decline the application without providing the claimant an opportunity to be considered.
In case of a registered certificate or license holder’s demise, the FSSAI license would only survive if the legal agent or any family member applies to transfer that certificate. If the FSSAI certificate is not within three months after the expiry of the holder of license or registration certificate, then it expires.
NOTE – transfer of certificate or license will be applicable only in case of license holder’s demise.
