Starting a New Business
Pick the right structure and get incorporated, from a one-person company to a private limited.
Popular Options
5 services
- Private Limited CompanyThe structure investors expect. Liability is capped at what each shareholder put in, shares can be issued to raise funds, and the company carries on regardless of who owns it.
- Limited Liability PartnershipA hybrid of the company and the partnership firm. Partners run it under an agreement of their own making, while personal assets stay out of reach of the business. Common for professional consultancies.
- One Person CompanyFull corporate status for a single owner. It is a private limited company in law, so liability is limited and the entity is separate, but one person holds it and no annual general meeting is required.
- Partnership FirmTwo or more people sharing the profits of a business they run together, under a deed rather than a filing with the MCA. The lighter compliance load is what makes it work at a small and medium scale.
- Sole Proprietorship FirmWhere most Indian entrepreneurs begin. One owner, no separate legal entity and the least paperwork of anything on this page, in exchange for unlimited personal liability.
Special Business Entities
3 services
- Indian SubsidiaryFor a foreign company or foreign national entering the Indian market. The Indian arm is registered as a corporate structure in its own right, which is the cleanest route to trading here.
- Section 8 CompanyRegistered for a charitable object rather than for profit. Unlike a trust it is a corporate body, so it carries limited liability and a separate existence of its own.
- Producer CompanyFormed by ten or more individuals engaged in primary produce, usually farming. It gives a producer group corporate status while ownership stays with its active members.
Intellectual Property
Secure the name, logo, invention or creative work your business is built on.
Trademark
5 services
- Trademark RegistrationThe first step to exclusive rights over your brand name, and the one that matters most: registration is what protects the mark rather than merely enhancing it.
- Trademark Objection ReplyAn application passes through several stages of examination. If the Registry issues an examination report, your grounds have to be put back to it, or the mark does not proceed.
- Trademark OppositionFound someone applying for a mark close to yours? An opposition is how you contest it. It is also what you answer if somebody opposes yours.
- Trademark AssignmentTransfer ownership, or the partial right to use your mark, to a third party. This is how brand value becomes an asset that can be sold or licensed rather than only defended.
- Trademark RenewalRegistration runs for ten years from the application date. Renew before it expires and the ownership rights continue uninterrupted.
Patent
3 services
- Patent SearchA patentability search looks for existing patents and other prior art close to your invention. Done by a patent attorney, before anything is filed, because it decides whether filing is worth it.
- Provisional PatentSecures a filing date while the invention is still being worked on. It carries a detailed description and drawings, and it is filed before the complete specification.
- Permanent PatentThe complete specification, which is the registration application itself. It describes the invention to its full extent, including the method of practising it.
